DJT alleges thousands of voters were disenfranchised by ssytematic improper tabulator overrides. DJT seeks an injunction providing for the review of the Ballot Duplication Board of all ballots not tabulated because of overvotes or other defects or irregularities preventing tabulation.  Secretary Hobbs argued the lawsuit was moot on 11/13 because the delta of overvotes at issue were not large enough to make the difference between winning or losing the race.  DJT partially agreed acknowledging the lawsuit was moot with respect to the presidential electors; however, issues remained regarding two local and state races.

DJT appealed a district court ruling that compelled Arizona officials to allow voters a five day period after election day in which to cure unsigned ballots.  DJT file a motion to stay the district court's ruling, which the Ninth Circuit granted while it considers the case.

Plaintiff seeks an injunction preventing Georgia from certifying its election results and/or order Georgia to cure the defects. An Amended Complaint was filed on 11/16 to add additional affidavits.

Plaintiffs sought an injunction preventing ballots received after November 3, 2020 at 8:00 PM from being counted and certified.  The Secretary attempted to extend the deadline by 14 days.  The state court issued an order requiring receipt of the ballots by November 3; Secretary Benson issued a statement indicating she intended to comply with the state court's ruling.  The plaintiffs entered a voluntary stipulation of dismissal.

DJT is seeking a restraining order preventing certification of PA's election results.  Several defendants filed separate motions to dismiss, which DJT opposed on 11/15.   DJT's counsel sought an extension of oral arguments scheduled for 11/17, which the court denied.  Oral argument will be 11/17. 

The lawsuit alleges (i) violation of Fourteenth Amendment for failure to allow effective observation and monitoring of vote counting on due process and equal protection grounds; (ii) violation of Fourteenth Amendment for disparate treatment of absentee/mail-in voters on equal protection and due process grounds and (iii) various violations of the Electors & Elections clauses of the U.S. Constitution.

The City of Philadelphia Board of Elections appealed the Commonwealth Court's decision above to the Supreme Court of Pennsylvania. The high court accepted the appeal and the parties submitted briefing on November 13, 2020.  The Supreme Court overturned the Commonwealth Court's decision.  The ruling is adverse to DJT.
